{"id":598,"date":"2016-04-26T10:02:03","date_gmt":"2016-04-26T07:02:03","guid":{"rendered":"http:\/\/www.yusuftur.com.tr\/?p=598"},"modified":"2016-04-26T10:02:03","modified_gmt":"2016-04-26T07:02:03","slug":"6704-sayili-torba-yasa-yururlukte","status":"publish","type":"post","link":"https:\/\/www.yusuftur.com.tr\/index.php\/6704-sayili-torba-yasa-yururlukte\/","title":{"rendered":"6704 Say\u0131l\u0131 Torba Yasa Y\u00fcr\u00fcrl\u00fckte"},"content":{"rendered":"<p>6704 Say\u0131l\u0131 65 Ya\u015f\u0131n\u0131 Doldurmu\u015f Muhta\u00e7, G\u00fc\u00e7s\u00fcz ve Kimsesiz T\u00fcrk Vatanda\u015flar\u0131na Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanun ile Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun, \u00a026 Nisan 2016 Tarihli ve 29695 Say\u0131l\u0131 Resm\u00ee Gazetede yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi.<!--more--><\/p>\n<p><strong>65 YA\u015eINI DOLDURMU\u015e MUHTA\u00c7, G\u00dc\u00c7S\u00dcZ VE K\u0130MSES\u0130Z T\u00dcRK VATANDA\u015eLARINA AYLIK BA\u011eLANMASI HAKKINDA KANUN \u0130LE BAZI KANUN VE KANUN H\u00dcKM\u00dcNDE KARARNAMELERDE DE\u011e\u0130\u015e\u0130KL\u0130K YAPILMASINA DA\u0130R KANUN <\/strong><\/p>\n<p>(26 Nisan 2016 Tarihli ve 29695 Say\u0131l\u0131 Resm\u00ee Gazete)<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"214\"><strong><u>Kanun No. 6704<\/u><\/strong><\/td>\n<td width=\"124\"><\/td>\n<td width=\"260\">\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<u>Kabul Tarihi: \u00a014\/4\/2016<\/u><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>MADDE 1-<\/strong> 1\/7\/1976 tarihli ve 2022 say\u0131l\u0131 65 Ya\u015f\u0131n\u0131 Doldurmu\u015f Muhta\u00e7, G\u00fc\u00e7s\u00fcz ve Kimsesiz T\u00fcrk Vatanda\u015flar\u0131na Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanunun 1 inci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201cMADDE 1- Sosyal g\u00fcvenlik kurulu\u015flar\u0131n\u0131n herhangi birisinden her ne nam alt\u0131nda olursa olsun bir gelir veya ayl\u0131k hakk\u0131ndan yararlananlar ile uzun vadeli sigorta kollar\u0131 a\u00e7\u0131s\u0131ndan zorunlu olarak sigortal\u0131 olunmas\u0131 gereken bir i\u015fte \u00e7al\u0131\u015fanlar, nafaka ba\u011flanm\u0131\u015f veya nafaka ba\u011flanmas\u0131 m\u00fcmk\u00fcn olanlar veya 24\/5\/1983 tarihli ve 2828 say\u0131l\u0131 Sosyal Hizmetler Kanunu h\u00fck\u00fcmlerine g\u00f6re har\u00e7l\u0131k \u00f6denenler hari\u00e7 olmak kayd\u0131yla, Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fma Vak\u0131flar\u0131 taraf\u0131ndan muhta\u00e7 oldu\u011funa karar verilen 65 ya\u015f\u0131n\u0131 doldurmu\u015f T\u00fcrk vatanda\u015flar\u0131na, muhta\u00e7l\u0131k h\u00e2li devam etti\u011fi m\u00fcddet\u00e7e (2.332) g\u00f6sterge rakam\u0131n\u0131n memur ayl\u0131k katsay\u0131s\u0131 ile \u00e7arp\u0131m\u0131ndan bulunacak tutarda ayl\u0131k ba\u011flan\u0131r.<\/p>\n<p>Birinci f\u0131kra kapsam\u0131na girenlerden, her ne nam alt\u0131nda olursa olsun kendisine ve e\u015fine ait her t\u00fcrl\u00fc gelirler toplam\u0131 esas al\u0131nmak suretiyle, ki\u015fi ba\u015f\u0131na d\u00fc\u015fen ortalama ayl\u0131k gelir tutar\u0131 asgari \u00fccretin ayl\u0131k net tutar\u0131n\u0131n 1\/3\u2019\u00fcnden fazla olanlar ile ayn\u0131 tutardan fazla gelir sa\u011flamas\u0131 m\u00fcmk\u00fcn olan kimseler muhta\u00e7 kabul edilemez ve kendilerine ayl\u0131k ba\u011flanamaz.<\/p>\n<p>65 ya\u015f\u0131n tespitinde, do\u011fum tarihlerinde yap\u0131lm\u0131\u015f d\u00fczeltmeler nazara al\u0131nmaz.\u201d<\/p>\n<p><strong>MADDE 2-<\/strong> 2022 say\u0131l\u0131 Kanunun 2 nci maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131n\u0131n ikinci c\u00fcmlesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201cBu Kanunun 1 inci maddesine g\u00f6re ayl\u0131k ba\u011flananlara; ba\u015fkas\u0131n\u0131n yard\u0131m\u0131 olmaks\u0131z\u0131n hayat\u0131n\u0131 devam ettiremeyecek kadar engelli olduklar\u0131n\u0131 ilgili mevzuat\u0131na g\u00f6re al\u0131nacak sa\u011fl\u0131k kurulu raporu ile kan\u0131tlamalar\u0131 ve birinci f\u0131kran\u0131n (a) bendi ile \u00fc\u00e7\u00fcnc\u00fc f\u0131kradaki ko\u015fullar\u0131 ta\u015f\u0131malar\u0131 h\u00e2linde, birinci f\u0131kran\u0131n (a) bendine g\u00f6re ayl\u0131k ba\u011flan\u0131r.\u201d<\/p>\n<p><strong>MADDE 3-<\/strong> 13\/10\/1983 tarihli ve 2918 say\u0131l\u0131 Karayollar\u0131 Trafik Kanununun 90 \u0131nc\u0131 maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201cMADDE 90- Zorunlu mali sorumluluk sigortas\u0131 kapsam\u0131ndaki tazminatlar bu Kanun ve bu Kanun \u00e7er\u00e7evesinde haz\u0131rlanan genel \u015fartlarda \u00f6ng\u00f6r\u00fclen usul ve esaslara tabidir. S\u00f6z konusu tazminatlar ve manevi tazminata ili\u015fkin olarak bu Kanun ve genel \u015fartlarda d\u00fczenlenmeyen hususlar hakk\u0131nda 11\/1\/2011 tarihli ve 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun haks\u0131z fiillere ili\u015fkin h\u00fck\u00fcmleri uygulan\u0131r.\u201d<\/p>\n<p><strong>MADDE 4-<\/strong> 2918 say\u0131l\u0131 Kanunun 92 nci maddesinin birinci f\u0131kras\u0131na a\u015fa\u011f\u0131daki bentler eklenmi\u015ftir.<\/p>\n<p>\u201cg) Hak sahibinin kendi kusuruna denk gelen tazminat talepleri,<\/p>\n<ol>\n<li>h) \u0130lgililerin, sigortal\u0131n\u0131n sorumluluk riski kapsam\u0131nda olmayan tazminat talepleri,<\/li>\n<li>i) Bu Kanun \u00e7er\u00e7evesinde haz\u0131rlanan zorunlu mali sorumluluk sigortas\u0131 genel \u015fartlar\u0131 ve ekleri ile tan\u0131mlanan teminat i\u00e7eri\u011fi d\u0131\u015f\u0131nda kalan talepler.\u201d<\/li>\n<\/ol>\n<p><strong>MADDE 5- <\/strong>2918 say\u0131l\u0131 Kanunun 97 nci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201cMADDE 97- Zarar g\u00f6renin, zorunlu mali sorumluluk sigortas\u0131nda \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlar i\u00e7inde dava yoluna gitmeden \u00f6nce ilgili sigorta kurulu\u015funa yaz\u0131l\u0131 ba\u015fvuruda bulunmas\u0131 gerekir. Sigorta kurulu\u015funun ba\u015fvuru tarihinden itibaren en ge\u00e7 15 g\u00fcn i\u00e7inde ba\u015fvuruyu yaz\u0131l\u0131 olarak cevaplamamas\u0131 veya verilen cevab\u0131n talebi kar\u015f\u0131lamad\u0131\u011f\u0131na ili\u015fkin uyu\u015fmazl\u0131k olmas\u0131 h\u00e2linde, zarar g\u00f6ren dava a\u00e7abilir veya 5684 say\u0131l\u0131 Kanun \u00e7er\u00e7evesinde tahkime ba\u015fvurabilir.\u201d<\/p>\n<p><strong>MADDE 6-<\/strong> 2918 say\u0131l\u0131 Kanunun 99 uncu maddesinin birinci f\u0131kras\u0131nda yer alan \u201ckaza veya zarara ili\u015fkin tespit tutana\u011f\u0131n\u0131 veya bilirki\u015fi raporunu\u201d ibaresi \u201czorunlu mali sorumluluk sigortas\u0131 genel \u015fartlar\u0131yla belirlenen belgeleri\u201d \u015feklinde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p><strong>MADDE 7-<\/strong> 3\/5\/1985 tarihli ve 3194 say\u0131l\u0131 \u0130mar Kanununun 5 inci maddesine \u201cBina\u201d tan\u0131m\u0131ndan sonra gelmek \u00fczere a\u015fa\u011f\u0131daki tan\u0131m eklenmi\u015ftir.<\/p>\n<p>\u201cSu yolu; imar plan\u0131 karar\u0131yla yapay olarak olu\u015fturulan ve deniz ara\u00e7lar\u0131yla ula\u015f\u0131m\u0131n sa\u011fland\u0131\u011f\u0131 su ge\u00e7ididir.\u201d<\/p>\n<p><strong>MADDE 8-<\/strong> 3194 say\u0131l\u0131 Kanunun 11 inci maddesinin birinci f\u0131kras\u0131na \u201cyol,\u201d ibaresinden sonra gelmek \u00fczere \u201csu yolu,\u201d ibaresi eklenmi\u015ftir.<\/p>\n<p><strong>MADDE 9- <\/strong>3194 say\u0131l\u0131 Kanunun 18 inci maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na \u201cyol\u201d ibaresinden sonra gelmek \u00fczere \u201cotoyol hari\u00e7 eri\u015fme kontrol\u00fcn\u00fcn uyguland\u0131\u011f\u0131 yol, su yolu,\u201d ibaresi eklenmi\u015ftir.<\/p>\n<p><strong>MADDE 10-<\/strong> 3194 say\u0131l\u0131 Kanuna a\u015fa\u011f\u0131daki ge\u00e7ici madde eklenmi\u015ftir.<\/p>\n<p>\u201cGE\u00c7\u0130C\u0130 MADDE 15- 16\/5\/2012 tarihli ve 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun uyar\u0131nca riskli alan, 5393 say\u0131l\u0131 Kanunun 73 \u00fcnc\u00fc maddesi uyar\u0131nca kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alan\u0131 ve 16\/6\/2005 tarihli ve 5366 say\u0131l\u0131 Y\u0131pranan Tarihi ve K\u00fclt\u00fcrel Ta\u015f\u0131nmaz Varl\u0131klar\u0131n Yenilenerek Korunmas\u0131 ve Ya\u015fat\u0131larak Kullan\u0131lmas\u0131 Hakk\u0131nda Kanun uyar\u0131nca yenileme alan\u0131 olarak belirlenen alanlarda bulunan yap\u0131lardan yap\u0131 ruhsatiyesi veya yap\u0131 kullanma izni bulunmayan yap\u0131lara, d\u00f6n\u00fc\u015f\u00fcm ve yenileme uygulamalar\u0131na muvafakat verilmesi ko\u015fuluyla, ge\u00e7ici olarak elektrik, su ve do\u011fal gaz ba\u011flant\u0131s\u0131 ve aboneli\u011fi yap\u0131l\u0131r. Bu yap\u0131lara ge\u00e7ici olarak elektrik, su ve do\u011fal gaz ba\u011flant\u0131s\u0131 ve aboneli\u011fi yap\u0131lmas\u0131 herhangi bir kazan\u0131lm\u0131\u015f hak te\u015fkil etmez.<\/p>\n<p>Birinci f\u0131kra uyar\u0131nca yap\u0131lan ge\u00e7ici abonelik s\u00fcresi be\u015f y\u0131l\u0131 ge\u00e7emez. Ancak d\u00f6n\u00fc\u015f\u00fcm ve yenileme uygulamalar\u0131n\u0131n uzamas\u0131 h\u00e2linde, be\u015f y\u0131l\u0131 ge\u00e7memek \u00fczere uygulama s\u00fcresince ge\u00e7ici abonelik uygulamas\u0131 devam eder.<\/p>\n<p>Bu madde h\u00fck\u00fcmleri 1\/11\/2015 tarihinden \u00f6nce yap\u0131lm\u0131\u015f yap\u0131lara ili\u015fkin olarak uygulan\u0131r.\u201d<\/p>\n<p><strong>MADDE 11-<\/strong> 29\/5\/1986 tarihli ve 3294 say\u0131l\u0131 Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fmay\u0131 Te\u015fvik Kanununa a\u015fa\u011f\u0131daki ek madde eklenmi\u015ftir.<\/p>\n<p>\u201cEK MADDE 5- \u0130\u015fe ba\u015flad\u0131\u011f\u0131 tarihten \u00f6nceki son bir y\u0131l i\u00e7erisinde Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fmay\u0131 Te\u015fvik Fonu Kurulu taraf\u0131ndan belirlenen nakd\u00ee d\u00fczenli sosyal yard\u0131mlardan en az bir defa yararlanm\u0131\u015f olanlar\u0131n ikamet etti\u011fi hanede 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 60 \u0131nc\u0131 maddesinin birinci f\u0131kras\u0131n\u0131n (c) bendinin (1) numaral\u0131 alt bendi kapsam\u0131nda bulunanlardan T\u00fcrkiye \u0130\u015f Kurumuna kay\u0131tl\u0131 i\u015fsizler aras\u0131nda olmas\u0131 kayd\u0131yla, 5510 say\u0131l\u0131 Kanunun 4 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendi kapsam\u0131nda \u00f6zel sekt\u00f6r i\u015fverenlerince istihdam edilen sigortal\u0131 i\u00e7in; 5510 say\u0131l\u0131 Kanunun 81 inci maddesinde say\u0131lan ve 5510 say\u0131l\u0131 Kanunun 82 nci maddesi uyar\u0131nca belirlenen prime esas kazan\u00e7 alt s\u0131n\u0131r\u0131 \u00fczerinden hesaplanan sigorta primlerinin i\u015fveren hisselerine ait tutar\u0131n tamam\u0131 i\u015fe ba\u015flad\u0131\u011f\u0131 tarihten itibaren bir y\u0131l s\u00fcreyle Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 taraf\u0131ndan kar\u015f\u0131lan\u0131r. Bakanlar Kurulu bu s\u00fcreyi bir y\u0131l uzatmaya yetkilidir.<\/p>\n<p>\u0130\u015fveren hisselerine ait primlerin kar\u015f\u0131lanabilmesi i\u00e7in i\u015fverenlerin \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 sigortal\u0131larla ilgili olarak; i\u015fe al\u0131nd\u0131klar\u0131 y\u0131ldan bir \u00f6nceki takvim y\u0131l\u0131nda i\u015fyerinden bildirilen ayl\u0131k prim ve hizmet belgelerindeki sigortal\u0131 say\u0131s\u0131n\u0131n ortalamas\u0131na ilave olmas\u0131, 5510 say\u0131l\u0131 Kanun uyar\u0131nca ayl\u0131k prim ve hizmet belgelerini yasal s\u00fcresi i\u00e7inde Sosyal G\u00fcvenlik Kurumuna vermesi, sigortal\u0131lar\u0131n tamam\u0131na ait sigorta primlerinin Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131nca kar\u015f\u0131lanmayan tutar\u0131 yasal s\u00fcresi i\u00e7inde \u00f6demesi ve kapsama giren sigortal\u0131n\u0131n i\u015fe al\u0131nd\u0131\u011f\u0131 i\u015fyerinden dolay\u0131 Sosyal G\u00fcvenlik Kurumuna prim, idari para cezas\u0131 ve bunlara ili\u015fkin gecikme cezas\u0131 ve gecikme zamm\u0131 borcu bulunmamas\u0131 \u015fartt\u0131r.<\/p>\n<p>Sosyal G\u00fcvenlik Kurumuna olan prim, idari para cezas\u0131 ve bunlara ili\u015fkin gecikme cezas\u0131 ve gecikme zamm\u0131 bor\u00e7lar\u0131n\u0131n 6183 say\u0131l\u0131 Kanunun 48 inci maddesine g\u00f6re tecil ve taksitlendirilmi\u015f veya ilgili kanunlar uyar\u0131nca prim bor\u00e7lar\u0131n\u0131n yeniden yap\u0131land\u0131r\u0131lm\u0131\u015f olmas\u0131, bu tecil, taksitlendirme ve yeniden yap\u0131land\u0131rma devam etti\u011fi s\u00fcrece i\u015fverenlerin bu madde h\u00fckm\u00fcnden yararlanmas\u0131na engel te\u015fkil etmez.<\/p>\n<p>Yap\u0131lan kontrol ve denetimlerde, \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 ki\u015fileri sigortal\u0131 olarak bildirmedi\u011fi tespit edilen i\u015fverenler bir y\u0131l s\u00fcreyle bu maddeyle sa\u011flanan destek unsurlar\u0131ndan yararlanamaz.<\/p>\n<p>Bu madde h\u00fck\u00fcmleri, 21\/4\/2005 tarihli ve 5335 say\u0131l\u0131 Baz\u0131 Kanun ve Kanun H\u00fckm\u00fcnde Kararnamelerde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanunun 30 uncu maddesinin ikinci f\u0131kras\u0131 kapsam\u0131na giren kurum ve kurulu\u015flara ait i\u015fyerleri ile bu i\u015fyerlerinin yapt\u0131rd\u0131\u011f\u0131 her t\u00fcrl\u00fc al\u0131m ve yap\u0131m i\u015flerine ili\u015fkin i\u015fyerleri, sosyal g\u00fcvenlik destek primine tabi \u00e7al\u0131\u015fanlar ve yurt d\u0131\u015f\u0131nda \u00e7al\u0131\u015fan sigortal\u0131lar hakk\u0131nda uygulanmaz.<\/p>\n<p>\u0130\u015fverenler bu maddeyle sa\u011flanan prim deste\u011finden ayn\u0131 sigortal\u0131 i\u00e7in birinci f\u0131kradaki s\u00fcreleri ge\u00e7memek \u00fczere yararlan\u0131r. Destekten yersiz olarak faydalan\u0131ld\u0131\u011f\u0131n\u0131n tespiti h\u00e2linde, yararlan\u0131lan te\u015fvik tutar\u0131 5510 say\u0131l\u0131 Kanunun 89 uncu maddesi uyar\u0131nca gecikme cezas\u0131 ve gecikme zamm\u0131yla birlikte i\u015fverenden tahsil edilir.<\/p>\n<p>Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fmay\u0131 Te\u015fvik Fonu Kurulu taraf\u0131ndan belirlenen nakd\u00ee d\u00fczenli sosyal yard\u0131mlardan i\u015fe ba\u015flad\u0131\u011f\u0131 tarihten \u00f6nceki son bir y\u0131l i\u00e7erisinde en az bir defa yararlanm\u0131\u015f olanlar\u0131n ikamet etti\u011fi hanede 5510 say\u0131l\u0131 Kanunun 60 \u0131nc\u0131 maddesinin birinci f\u0131kras\u0131n\u0131n (c) bendinin (1) numaral\u0131 alt bendi kapsam\u0131nda bulunanlardan \u00e7al\u0131\u015fabilir durumda olanlar, Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 taraf\u0131ndan b\u00fct\u00fcnle\u015fik sosyal yard\u0131m sistemi \u00fczerinden T\u00fcrkiye \u0130\u015f Kurumu sistemine kaydedilir. Bu ki\u015filer T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan mesleki e\u011fitime veya di\u011fer aktif i\u015f g\u00fcc\u00fc programlar\u0131na tabi tutulur. Mesleki e\u011fitimi veya aktif i\u015f g\u00fcc\u00fc programlar\u0131n\u0131 ya da T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan teklif edilen i\u015fi \u00fc\u00e7\u00fcnc\u00fc kez kabul etmeyenlerin Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fmay\u0131 Te\u015fvik Fonu Kurulu taraf\u0131ndan belirlenen nakd\u00ee d\u00fczenli sosyal yard\u0131mlar\u0131, durumun b\u00fct\u00fcnle\u015fik sosyal yard\u0131m sistemi \u00fczerinden T\u00fcrkiye \u0130\u015f Kurumu veri taban\u0131ndan tespit edilmesini takip eden ay ba\u015f\u0131ndan itibaren bir y\u0131l s\u00fcreyle kesilir.<\/p>\n<p>Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131nca kar\u015f\u0131lanan prim tutarlar\u0131, gelir ve kurumlar vergisi uygulamalar\u0131nda gider veya maliyet unsuru olarak dikkate al\u0131nmaz.<\/p>\n<p>Bu madde kapsam\u0131na giren sosyal yard\u0131mlar ve bu maddenin uygulanmas\u0131na ili\u015fkin usul ve esaslar Maliye Bakanl\u0131\u011f\u0131, Sosyal G\u00fcvenlik Kurumu ile T\u00fcrkiye \u0130\u015f Kurumunun g\u00f6r\u00fc\u015fleri al\u0131narak Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131nca belirlenir.\u201d<\/p>\n<p><strong>MADDE 12-<\/strong> 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanununun ek 1 inci maddesinin birinci ve yedinci f\u0131kralar\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f; be\u015finci f\u0131kras\u0131n\u0131n sonuna a\u015fa\u011f\u0131daki c\u00fcmle eklenmi\u015f; sekizinci f\u0131kras\u0131n\u0131n ikinci ve \u00fc\u00e7\u00fcnc\u00fc c\u00fcmleleri a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (\u00e7) bendinde yer alan \u201chayat\u0131n\u0131 kaybedenlerin ise e\u015f ve \u00e7ocuklar\u0131ndan birisi, e\u015fi veya \u00e7ocu\u011fu yoksa\u201d ibaresinden sonra gelmek \u00fczere \u201canne, baba veya\u201d ibaresi eklenmi\u015ftir.<\/p>\n<p>\u201c10\/12\/2003 tarihli ve 5018 say\u0131l\u0131 Kamu Mal\u00ee Y\u00f6netimi ve Kontrol Kanununun eki (I), (II), (III) ve (IV) say\u0131l\u0131 cetvellerde yer alan kamu kurum ve kurulu\u015flar\u0131, kamu iktisadi te\u015febb\u00fcsleri ve ba\u011fl\u0131 ortakl\u0131klar\u0131, il \u00f6zel idareleri, belediyeler ve ba\u011fl\u0131 kurulu\u015flar\u0131, \u00f6zel kanunla kurulan di\u011fer her t\u00fcrl\u00fc kamu kurum ve kurulu\u015flar\u0131; 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununa tabi memur kadrolar\u0131 ile s\u00f6zle\u015fmeli personel pozisyonlar\u0131na ve s\u00fcrekli i\u015f\u00e7i kadrolar\u0131na bu madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131nca hak sahibi oldu\u011fu belirlenerek Devlet Personel Ba\u015fkanl\u0131\u011f\u0131na bildirilen ve Ba\u015fkanl\u0131k\u00e7a kura sonucu atama teklifi yap\u0131lanlar\u0131 atamak zorundad\u0131r.\u201d<\/p>\n<p>\u201cBu madde kapsam\u0131nda g\u00f6reve ba\u015flayan personel, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan atama teklifinin yap\u0131ld\u0131\u011f\u0131 tarihte \u00f6\u011frenim durumlar\u0131 itibar\u0131yla ihraz ettikleri unvanlara ili\u015fkin kadro veya pozisyonlara, kamu kurum ve kurulu\u015flar\u0131nca s\u0131nava tabi olmaks\u0131z\u0131n atanabilirler.\u201d<\/p>\n<p>\u201cAncak \u00fc\u00e7\u00fcnc\u00fc f\u0131kran\u0131n (a), (b), (c) ve (\u00e7) bentlerinde say\u0131lan ki\u015fi veya ki\u015filerden istihdam hakk\u0131n\u0131 kullanacak 45 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck herhangi bir ki\u015finin bulunmamas\u0131 durumunda 45 ya\u015f\u0131ndan b\u00fcy\u00fck hak sahipleri istihdam hakk\u0131ndan faydalanabilirler.\u201d<\/p>\n<p>\u201cHak sahiplerinin kamu kurum ve kurulu\u015flar\u0131na atama teklifleri, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131nca k\u0131rk be\u015f g\u00fcn i\u00e7inde kura usul\u00fc ile yap\u0131l\u0131r. Kura sonucu yap\u0131lacak atamalarda atama teklifinin yap\u0131lmas\u0131 ile birlikte di\u011fer kanunlardaki h\u00fck\u00fcmlere bak\u0131lmaks\u0131z\u0131n ve ba\u015fka bir i\u015fleme gerek kalmaks\u0131z\u0131n atama teklifi yap\u0131lan kamu kurum ve kurulu\u015flar\u0131na kadro ve pozisyonlar ihdas, tahsis ve vize edilmi\u015f ve mevzuat\u0131 uyar\u0131nca d\u00fczenlenen ilgili cetvel ve b\u00f6l\u00fcmlere eklenmi\u015f say\u0131l\u0131r. Bu \u015fekilde ihdas edilen kadro ve pozisyonlar, herhangi bir \u015fekilde bo\u015falmas\u0131 h\u00e2linde ba\u015fka bir i\u015fleme gerek kalmaks\u0131z\u0131n iptal edilmi\u015f say\u0131l\u0131r.\u201d<\/p>\n<p><strong>MADDE 13-<\/strong> 25\/2\/1998 tarihli ve 4342 say\u0131l\u0131 Mera Kanununa a\u015fa\u011f\u0131daki ek madde eklenmi\u015ftir.<\/p>\n<p>\u201cEK MADDE 1- 30\/4\/2014 tarihli ve 28987 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan 24\/2\/2014 tarihli ve 2014\/6028 say\u0131l\u0131 Bakanlar Kurulu Karar\u0131nda belirtilen; \u0130stanbul \u0130li Avrupa Yakas\u0131 Proje Alan\u0131 i\u00e7erisinde yer alan mera, yaylak ve k\u0131\u015flak gibi orta mallar\u0131n\u0131n vas\u0131flar\u0131, Ula\u015ft\u0131rma, Denizcilik ve Haberle\u015fme Bakanl\u0131\u011f\u0131nca bu Kanun h\u00fck\u00fcmlerine ba\u011fl\u0131 kal\u0131nmaks\u0131z\u0131n resen kald\u0131r\u0131l\u0131r ve bu ta\u015f\u0131nmazlar Hazine ad\u0131na tescil edilir.\u201d<\/p>\n<p><strong>MADDE 14-<\/strong> 25\/6\/2001 tarihli ve 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 ve Toplu S\u00f6zle\u015fme Kanununun 19 uncu maddesinin ikinci f\u0131kras\u0131na a\u015fa\u011f\u0131daki bent eklenmi\u015ftir.<\/p>\n<p>\u201c\u0131) Gerekti\u011finde, nakit mevcudunun y\u00fczde onunu a\u015fmamak kayd\u0131yla ve Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 ile koordinasyon halinde, 8\/6\/1949 tarihli ve 5434 say\u0131l\u0131 T\u00fcrkiye Cumhuriyeti Emekli Sand\u0131\u011f\u0131 Kanununun m\u00fclga 64 \u00fcnc\u00fc maddesi ve 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 47 nci maddesinin sekizinci f\u0131kras\u0131nda say\u0131lanlar ile 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu, 3\/11\/1980 tarihli ve 2330 say\u0131l\u0131 Nakdi Tazminat ve Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanun, 17\/7\/2004 tarihli ve 5233 say\u0131l\u0131 Ter\u00f6r ve Ter\u00f6rle M\u00fccadeleden Do\u011fan Zararlar\u0131n Kar\u015f\u0131lanmas\u0131 Hakk\u0131nda Kanunun ek 1 inci maddesi h\u00fck\u00fcmlerine g\u00f6re nakd\u00ee tazminat \u00f6denmesi veya ayl\u0131k ba\u011flanmas\u0131 hakk\u0131 bulunanlara ayn\u00ee ve nakd\u00ee yard\u0131mda bulunmak.\u201d<\/p>\n<p><strong>MADDE 15-<\/strong> 29\/6\/2001 tarihli ve 4706 say\u0131l\u0131 Hazineye Ait Ta\u015f\u0131nmaz Mallar\u0131n De\u011ferlendirilmesi ve Katma De\u011fer Vergisi Kanununda De\u011fi\u015fiklik Yap\u0131lmas\u0131 Hakk\u0131nda Kanuna a\u015fa\u011f\u0131daki ge\u00e7ici madde eklenmi\u015ftir.<\/p>\n<p>\u201cGE\u00c7\u0130C\u0130 MADDE 19- \u0130lgili mevzuat\u0131 uyar\u0131nca K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 ile Maliye Bakanl\u0131\u011f\u0131 taraf\u0131ndan \u00fczerinde konaklama ama\u00e7l\u0131 turizm tesisleri yap\u0131lmak \u00fczere adlar\u0131na kamu arazisi tahsis edilen belgeli yat\u0131r\u0131mc\u0131lar ve i\u015fletmecilerden; irtifak hakk\u0131 tesis edilip edilmedi\u011fine veya kullanma izni verilip verilmedi\u011fine bak\u0131lmaks\u0131z\u0131n 1\/1\/2016 tarihi ile 31\/12\/2016 tarihi aras\u0131ndaki d\u00f6nemde tahsil edilmesi gereken kira, kesin tahsis, irtifak hakk\u0131, kullanma izni bedelleri ve has\u0131lat paylar\u0131 ile K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131ndan belgeli konaklama tesisleri taraf\u0131ndan Hazine ta\u015f\u0131nmazlar\u0131n\u0131n izinsiz kullan\u0131mlar\u0131ndan dolay\u0131 ayn\u0131 d\u00f6nemde tahakkuk ettirilerek tahsil edilmesi gereken ecrimisillerin \u00f6deme s\u00fcreleri bir y\u0131l ertelenir. Ertelenen alacaklar, bu s\u00fcrenin sona erdi\u011fi tarihten itibaren \u00fc\u00e7 y\u0131lda ve \u00fc\u00e7 e\u015fit taksitle herhangi bir zam veya faiz uygulanmadan tahsil edilir. S\u00fcresinde \u00f6denmeyen taksitler ilgili mevzuat\u0131 gere\u011fi zam veya faiz uygulanarak tahsil edilir.<\/p>\n<p>Birinci f\u0131kra uyar\u0131nca ertelenen bedel ve paylardan bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce tahsil edilenler, ilgililerince talep edilmesi h\u00e2linde iade veya erteleme s\u00fcresinin sona erdi\u011fi tarihten sonra tahsil edilmesi gereken bedellere mahsup edilir.<\/p>\n<p>Birinci f\u0131kra kapsam\u0131nda olan bor\u00e7lular\u0131n bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihi takip eden d\u00f6rd\u00fcnc\u00fc ay\u0131n sonuna kadar ilgili tahsil dairelerine ba\u015fvurmalar\u0131 \u015fart\u0131yla, bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih itibar\u0131yla vadesi geldi\u011fi h\u00e2lde \u00f6denmemi\u015f olan ecrimisil bor\u00e7lar\u0131 ile maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihe kadar (bu tarih hari\u00e7) hesaplanacak gecikme zamlar\u0131; ilk taksit 2017 y\u0131l\u0131 eyl\u00fcl ay\u0131nda, m\u00fcteakip taksitler de izleyen y\u0131llar\u0131n ayn\u0131 ay\u0131nda \u00f6denmek \u00fczere ve taksit s\u00fcresince herhangi bir zam ve faiz uygulanmaks\u0131z\u0131n \u00fc\u00e7 e\u015fit taksitte \u00f6denir. \u015eu kadar ki, s\u00fcresinde \u00f6denmeyen taksitler, taksit \u00f6deme s\u00fcresinden sonraki s\u00fcreye gecikme zamm\u0131 uygulanmak suretiyle 21\/7\/1953 tarihli ve 6183 say\u0131l\u0131 Amme Alacaklar\u0131n\u0131n Tahsil Usul\u00fc Hakk\u0131nda Kanun h\u00fck\u00fcmlerine g\u00f6re takip ve tahsil edilir. Bu f\u0131kra h\u00fck\u00fcmlerinden yararlanmak isteyen bor\u00e7lular\u0131n f\u0131krada belirtilen \u015fartlar\u0131n yan\u0131 s\u0131ra dava a\u00e7mamalar\u0131, a\u00e7\u0131lm\u0131\u015f davalardan vazge\u00e7meleri ve kanun yollar\u0131na ba\u015fvurmamalar\u0131 \u015fartt\u0131r. Bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce tahsil edilmi\u015f olan tutarlar red ve iade edilmez.<\/p>\n<p>Bu maddenin uygulamas\u0131na ili\u015fkin usul ve esaslar\u0131 belirlemeye Maliye Bakanl\u0131\u011f\u0131 yetkilidir.\u201d<\/p>\n<p><strong>MADDE 16-<\/strong> 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanununun 56 nc\u0131 maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201cAncak, 53 \u00fcnc\u00fc maddede \u00f6ng\u00f6r\u00fclen izin s\u00fcreleri, taraflar\u0131n anla\u015fmas\u0131 ile bir b\u00f6l\u00fcm\u00fc on g\u00fcnden a\u015fa\u011f\u0131 olmamak \u00fczere b\u00f6l\u00fcmler h\u00e2linde kullan\u0131labilir.\u201d<\/p>\n<p><strong>MADDE 17-<\/strong> 10\/7\/2003 tarihli ve 4925 say\u0131l\u0131 Karayolu Ta\u015f\u0131ma Kanununun 3 \u00fcnc\u00fc maddesinde yer alan \u201cSorumluluk sigortas\u0131\u201d tan\u0131m\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve ayn\u0131 Kanunun 17 nci, 18 inci, 19 uncu, 20 nci, 21 inci, 22 nci, 23 \u00fcnc\u00fc, 24 \u00fcnc\u00fc ve 25 inci maddeleri ile 26 nc\u0131 maddesinin birinci f\u0131kras\u0131n\u0131n (\u0131) ve (i) bentleri y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u201cSorumluluk sigortas\u0131: 2918 say\u0131l\u0131 Karayollar\u0131 Trafik Kanununda belirtilen zorunlu mali sorumluluk sigortas\u0131n\u0131,\u201d<\/p>\n<p><strong>MADDE 18- <\/strong>Ekli (1) ve (2) say\u0131l\u0131 listede yer alan kadrolar ihdas edilerek 13\/12\/1983 tarihli ve 190 say\u0131l\u0131 Genel Kadro ve Usul\u00fc Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin eki (I) say\u0131l\u0131 cetvelin Sosyal G\u00fcvenlik Kurumuna ve Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcne ait b\u00f6l\u00fcmlerine eklenmi\u015ftir.<\/p>\n<p><strong>MADDE 19-<\/strong> 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununa a\u015fa\u011f\u0131daki ge\u00e7ici madde eklenmi\u015ftir.<\/p>\n<p>\u201cGE\u00c7\u0130C\u0130 MADDE 69- Bu maddenin yay\u0131m\u0131 tarihinden \u00f6nce 60 \u0131nc\u0131 maddenin birinci f\u0131kras\u0131n\u0131n (g) bendi kapsam\u0131ndaki genel sa\u011fl\u0131k sigortal\u0131lar\u0131n\u0131n 25 ya\u015f\u0131n\u0131 doldurduklar\u0131 g\u00fcne kadar olan genel sa\u011fl\u0131k sigortas\u0131 primlerinin tahsilinden vazge\u00e7ilir. Bu maddenin yay\u0131mland\u0131\u011f\u0131 tarihe kadar s\u00f6z konusu s\u00fcreler i\u00e7in \u00f6denmi\u015f olan primler iade ve mahsup edilmez.\u201d<\/p>\n<p><strong>MADDE 20-<\/strong> 11\/10\/2006 tarihli ve 5549 say\u0131l\u0131 Su\u00e7 Gelirlerinin Aklanmas\u0131n\u0131n \u00d6nlenmesi Hakk\u0131nda Kanuna 19 uncu maddesinden sonra gelmek \u00fczere a\u015fa\u011f\u0131daki madde eklenmi\u015ftir.<\/p>\n<p>\u201c\u0130\u015flemlerin ertelenmesi<\/p>\n<p>MADDE 19\/A- (1) Y\u00fck\u00fcml\u00fcler nezdinde veya bunlar arac\u0131l\u0131\u011f\u0131yla yap\u0131lmaya te\u015febb\u00fcs edilen ya da h\u00e2lihaz\u0131rda devam eden i\u015flemleri, i\u015fleme konu malvarl\u0131\u011f\u0131n\u0131n aklama veya ter\u00f6r\u00fcn finansman\u0131 su\u00e7u ile ili\u015fkili oldu\u011funa dair \u015f\u00fcphe bulunmas\u0131 \u00fczerine; Ba\u015fkanl\u0131k\u00e7a \u015f\u00fcpheyi teyit etmek, i\u015flemi analiz etmek ya da gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fcnde analiz sonu\u00e7lar\u0131n\u0131 yetkili makamlara intikal ettirmek amac\u0131yla yedi i\u015f g\u00fcn\u00fc s\u00fcreyle ask\u0131ya almaya veya bu i\u015flemlerin ayn\u0131 s\u00fcreyle ger\u00e7ekle\u015fmesine izin vermemeye Bakan yetkilidir.<\/p>\n<p>(2) Bu yetki, yabanc\u0131 bir muadil kurulu\u015fun i\u015flemin ask\u0131ya al\u0131nmas\u0131 veya ger\u00e7ekle\u015fmesine izin verilmemesi y\u00f6n\u00fcndeki gerek\u00e7eli talebinde yer alan i\u015flemler hakk\u0131nda da Ba\u015fkanl\u0131k\u00e7a aklama veya ter\u00f6r\u00fcn finansman\u0131 su\u00e7u ile ili\u015fkili oldu\u011funa dair \u015f\u00fcphe g\u00f6r\u00fclmesi \u015fart\u0131yla m\u00fctekabiliyet ilkesi g\u00f6zetilerek kullan\u0131labilir.<\/p>\n<p>(3) Bu maddenin uygulanmas\u0131na ili\u015fkin di\u011fer usul ve esaslar Bakanl\u0131k taraf\u0131ndan \u00e7\u0131kar\u0131lan y\u00f6netmelikle belirlenir.\u201d<\/p>\n<p><strong>MADDE 21-<\/strong> 16\/5\/2012 tarihli ve 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanunun 3 \u00fcnc\u00fc maddesinin Anayasa Mahkemesince iptal edilen yedinci f\u0131kras\u0131 a\u015fa\u011f\u0131daki \u015fekilde yeniden d\u00fczenlenmi\u015ftir.<\/p>\n<p>\u201c(7) Bu Kanunun uygulanmas\u0131 i\u00e7in belirlenen alanlar\u0131n s\u0131n\u0131rlar\u0131 i\u00e7inde olup riskli yap\u0131lar d\u0131\u015f\u0131nda kalan di\u011fer yap\u0131lardan uygulama b\u00fct\u00fcnl\u00fc\u011f\u00fc bak\u0131m\u0131ndan Bakanl\u0131k\u00e7a gerekli g\u00f6r\u00fclenler, de\u011ferleme \u00e7al\u0131\u015fmalar\u0131nda yap\u0131n\u0131n riskli olmad\u0131\u011f\u0131 g\u00f6zetilmek kayd\u0131yla bu Kanun h\u00fck\u00fcmlerine tabi olur.\u201d<\/p>\n<p><strong>MADDE 22-<\/strong> 6306 say\u0131l\u0131 Kanunun 4 \u00fcnc\u00fc maddesinin Anayasa Mahkemesince iptal edilen birinci f\u0131kras\u0131 a\u015fa\u011f\u0131daki \u015fekilde yeniden d\u00fczenlenmi\u015ftir.<\/p>\n<p>\u201c(1) Bakanl\u0131k veya uygulamay\u0131 y\u00fcr\u00fctmesi h\u00e2linde TOK\u0130 veya \u0130dare, riskli alanlarda ve rezerv yap\u0131 alanlar\u0131nda her t\u00fcrl\u00fc imar ve yap\u0131la\u015fma i\u015flemlerini iki y\u0131l s\u00fcre ile ge\u00e7ici olarak durdurabilir. Uygulaman\u0131n gerektirmesi h\u00e2linde imar ve yap\u0131la\u015fma i\u015flemlerinin ge\u00e7ici olarak durdurulmas\u0131 bir y\u0131l daha uzat\u0131labilir.\u201d<\/p>\n<p><strong>MADDE 23-<\/strong> 6306 say\u0131l\u0131 Kanunun 6 nc\u0131 maddesinin birinci f\u0131kras\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve ikinci f\u0131kras\u0131n\u0131n d\u00f6rd\u00fcnc\u00fc c\u00fcmlesine \u201cy\u00fcr\u00fct\u00fclmesi\u201d ibaresinden sonra gelmek \u00fczere \u201cve bu Kanun uyar\u0131nca yap\u0131lacak di\u011fer i\u015flemler\u201d ibaresi eklenmi\u015ftir.<\/p>\n<p>\u201c(1) \u00dczerindeki bina y\u0131k\u0131larak arsa h\u00e2line gelen ta\u015f\u0131nmazlarda daha \u00f6nce kurulmu\u015f olan kat irtifak\u0131 veya kat m\u00fclkiyeti, ilgililerin muvafakatleri aranmaks\u0131z\u0131n Bakanl\u0131\u011f\u0131n talebi \u00fczerine ilgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce resen terkin edilerek, \u00f6nceki vasf\u0131 ile de\u011ferlemede bulunularak veya malik ile yap\u0131lan anla\u015fman\u0131n \u015fartlar\u0131 tapu k\u00fct\u00fc\u011f\u00fcnde belirtilerek malikleri ad\u0131na paylar\u0131 oran\u0131nda tescil edilir. Ta\u015f\u0131nmazlar\u0131n niteli\u011fi resen mevcut duruma g\u00f6re tescil edilir. Bu ta\u015f\u0131nmazlar\u0131n sicilinde bulunan ayni ve \u015fahsi haklar ile temlik hakk\u0131n\u0131 k\u0131s\u0131tlayan veya yasaklayan her t\u00fcrl\u00fc \u015ferh, hisseler \u00fczerinde devam eder. Belirtilen haklar ve \u015ferhler, tapuda; tevhit, ifraz, terk, tescil, kat irtifak\u0131 ve kat m\u00fclkiyeti tesisine ili\u015fkin i\u015flemlerin yap\u0131lmas\u0131na engel te\u015fkil etmez ve bu i\u015flemlerde muvafakat aranmaz. Bu \u015fekilde belirlenen uygulama alan\u0131nda cins de\u011fi\u015fikli\u011fi, tevhit, ifraz, terk, ihdas ve tescil i\u015flemleri muvafakat aranmaks\u0131z\u0131n Bakanl\u0131k, TOK\u0130 veya \u0130dare taraf\u0131ndan resen yap\u0131l\u0131r veya yapt\u0131r\u0131l\u0131r. Bu parsellerin malikleri taraf\u0131ndan de\u011ferlendirilmesi esast\u0131r. Bu \u00e7er\u00e7evede riskli alanlar ve rezerv yap\u0131 alanlar\u0131nda uygulama yap\u0131lan etap veya adada, riskli yap\u0131larda ise bu yap\u0131lar\u0131n bulundu\u011fu parsellerde, yap\u0131lar y\u0131kt\u0131r\u0131lmadan \u00f6nce, parsellerin tevhit edilmesine, m\u00fcnferit veya birle\u015ftirilerek veya imar adas\u0131 baz\u0131nda uygulama yap\u0131lmas\u0131na, ifraz, terk, ihdas ve tapuya tescil i\u015flemlerine, yeniden bina yapt\u0131r\u0131lmas\u0131na, paylar\u0131n sat\u0131\u015f\u0131na, kat kar\u015f\u0131l\u0131\u011f\u0131 veya has\u0131lat payla\u015f\u0131m\u0131 ve di\u011fer usuller ile yeniden de\u011ferlendirilmesine, yap\u0131n\u0131n payda\u015f\u0131 olup olmad\u0131klar\u0131 g\u00f6zetilmeksizin sahip olduklar\u0131 hisseleri oran\u0131nda payda\u015flar\u0131n en az \u00fc\u00e7te iki \u00e7o\u011funlu\u011fu ile karar verilir. Bu karara kat\u0131lmayanlar\u0131n arsa paylar\u0131, Bakanl\u0131k\u00e7a rayi\u00e7 de\u011feri tespit ettirilerek ve bu de\u011ferden az olmamak \u00fczere anla\u015fma sa\u011flayan di\u011fer payda\u015flara a\u00e7\u0131k art\u0131rma usul\u00fc ile sat\u0131l\u0131r. Bu suretle payda\u015flara sat\u0131\u015f ger\u00e7ekle\u015ftirilemedi\u011fi takdirde, bu paylar, Bakanl\u0131\u011f\u0131n talebi \u00fczerine, tespit edilen rayi\u00e7 bedeli de Bakanl\u0131k\u00e7a \u00f6denmek kayd\u0131 ile tapuda Hazine ad\u0131na resen tescil edilir ve yap\u0131lan anla\u015fma \u00e7er\u00e7evesinde de\u011ferlendirilmek \u00fczere Bakanl\u0131\u011fa tahsis edilmi\u015f say\u0131l\u0131r veya Bakanl\u0131k\u00e7a uygun g\u00f6r\u00fclenler TOK\u0130\u2019ye veya \u0130dareye devredilir. Bu durumda, payda\u015flar\u0131n karar\u0131 ile yap\u0131lan anla\u015fmaya uyularak i\u015flem yap\u0131l\u0131r. A\u00e7\u0131k art\u0131rma ile sat\u0131\u015f\u0131 yap\u0131lacak paylar\u0131n \u00fczerindeki ipotek, ihtiyati haciz, haciz ve intifa hakk\u0131 gibi haklar, sat\u0131\u015f sonras\u0131nda sat\u0131\u015f bedeli \u00fczerinde devam eder. Sat\u0131\u015f i\u015flemi sonras\u0131nda tapu kayd\u0131ndaki haklar ve \u015ferhler Bakanl\u0131\u011f\u0131n talebi \u00fczerine tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce resen terkin edilir.\u201d<\/p>\n<p><strong>MADDE 24-<\/strong> 6306 say\u0131l\u0131 Kanunun 7 nci maddesinin onuncu f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201cGer\u00e7ek ki\u015filerce ve \u00f6zel hukuk t\u00fczel ki\u015filerince uygulamada bulunulan riskli alanlardaki\u201d ibaresi, \u201cRiskli alanlarda, rezerv yap\u0131 alanlar\u0131nda ve riskli yap\u0131lar\u0131n bulundu\u011fu parsellerde, ger\u00e7ek ki\u015filerce ve \u00f6zel hukuk t\u00fczel ki\u015filerince uygulamada bulunulmas\u0131 h\u00e2linde,\u201d \u015feklinde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p><strong>MADDE 25- <\/strong>6306 say\u0131l\u0131 Kanuna a\u015fa\u011f\u0131daki ek madde eklenmi\u015ftir.<\/p>\n<p>\u201cEK MADDE 1- (1) a) Kamu d\u00fczeni veya g\u00fcvenli\u011finin ola\u011fan hayat\u0131 durduracak veya kesintiye u\u011fratacak \u015fekilde bozuldu\u011fu yerlerde; planlama ya da altyap\u0131 hizmetleri yetersiz olan veya imar mevzuat\u0131na ayk\u0131r\u0131 yap\u0131la\u015fma bulunan yahut yap\u0131 ya da altyap\u0131s\u0131 hasarl\u0131 olan alanlar,<\/p>\n<ol>\n<li>b) \u00dczerindeki toplam yap\u0131 say\u0131s\u0131n\u0131n en az %65\u2019i imar mevzuat\u0131na ayk\u0131r\u0131 olan veya yap\u0131 ruhsat\u0131 al\u0131nmaks\u0131z\u0131n in\u015fa edilmi\u015f olmakla birlikte sonradan yap\u0131 ve isk\u00e2n ruhsat\u0131 alan yap\u0131lardan olu\u015fan alanlar,<\/li>\n<\/ol>\n<p>fen ve sanat norm ve standartlar\u0131na uygun, sa\u011fl\u0131kl\u0131 ve g\u00fcvenli ya\u015fama \u00e7evrelerini te\u015fkil etmek, sa\u011fl\u0131k, e\u011fitim ve ula\u015f\u0131m gibi kamu hizmetlerinin d\u00fczenli bir \u015fekilde y\u00fcr\u00fct\u00fclmesini sa\u011flamak amac\u0131yla, Bakanl\u0131\u011f\u0131n teklifi \u00fczerine Bakanlar Kurulunca riskli alan olarak kararla\u015ft\u0131r\u0131labilir. Riskli alan s\u0131n\u0131r\u0131 uygulama b\u00fct\u00fcnl\u00fc\u011f\u00fc g\u00f6zetilerek belirlenir.<\/p>\n<p>(2) a) Riskli alan karar\u0131na kar\u015f\u0131 Resm\u00ee Gazete\u2019de yay\u0131m\u0131 tarihinden itibaren dava a\u00e7\u0131labilir. Uygulama i\u015flemleri \u00fczerine riskli alan karar\u0131na kar\u015f\u0131 dava a\u00e7\u0131lamaz.<\/p>\n<ol>\n<li>b) Birinci f\u0131kran\u0131n (a) bendi uyar\u0131nca belirlenen riskli alanlarda kamu kayna\u011f\u0131 kullan\u0131larak ger\u00e7ekle\u015ftirilen her t\u00fcrl\u00fc mal ve hizmet al\u0131mlar\u0131 ile yap\u0131m i\u015fleri, 4734 say\u0131l\u0131 Kanunun 21 inci maddesinin birinci f\u0131kras\u0131n\u0131n (b) bendinde belirtilen h\u00e2llere dayanan i\u015flerden say\u0131l\u0131r.\u201d<\/li>\n<\/ol>\n<p><strong>MADDE 26-<\/strong> 18\/10\/2012 tarihli ve 6356 say\u0131l\u0131 Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanununun 28 inci maddesinin yedinci f\u0131kras\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>\u201c(7) Kurulu\u015flar, y\u00f6netim kurulu karar\u0131yla ve nakit mevcudunun y\u00fczde onunu a\u015fmamak kayd\u0131yla;<\/p>\n<ol>\n<li>a) Yurt i\u00e7i ve yurt d\u0131\u015f\u0131ndaki do\u011fal afet b\u00f6lgelerine do\u011frudan veya yetkili makamlar arac\u0131l\u0131\u011f\u0131yla konut, e\u011fitim ve sa\u011fl\u0131k tesisleri kurulmas\u0131 amac\u0131yla kamu kurum ve kurulu\u015flar\u0131na,<\/li>\n<li>b) Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 ile koordinasyon h\u00e2linde, 8\/6\/1949 tarihli ve 5434 say\u0131l\u0131 T\u00fcrkiye Cumhuriyeti Emekli Sand\u0131\u011f\u0131 Kanununun m\u00fclga 64 \u00fcnc\u00fc maddesi ve 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 47 nci maddesinin sekizinci f\u0131kras\u0131nda say\u0131lanlar ile 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu, 3\/11\/1980 tarihli ve 2330 say\u0131l\u0131 Nakdi Tazminat ve Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanun, 17\/7\/2004 tarihli ve 5233 say\u0131l\u0131 Ter\u00f6r ve Ter\u00f6rle M\u00fccadeleden Do\u011fan Zararlar\u0131n Kar\u015f\u0131lanmas\u0131 Hakk\u0131nda Kanunun ek 1 inci maddesi h\u00fck\u00fcmlerine g\u00f6re nakd\u00ee tazminat \u00f6denmesi veya ayl\u0131k ba\u011flanmas\u0131 hakk\u0131 bulunanlara,<\/li>\n<\/ol>\n<p>ayni ve nakd\u00ee yard\u0131mda bulunabilir.\u201d<\/p>\n<p><strong>MADDE 27-<\/strong> 6\/12\/2012 tarihli ve 6362 say\u0131l\u0131 Sermaye Piyasas\u0131 Kanununun 78 inci maddesinin birinci, ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131 a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve ayn\u0131 maddeye a\u015fa\u011f\u0131daki f\u0131kralar eklenmi\u015ftir.<\/p>\n<p>\u201c(1) Kurul, merkez\u00ee takas kurulu\u015flar\u0131n\u0131n, al\u0131c\u0131ya kar\u015f\u0131 sat\u0131c\u0131, sat\u0131c\u0131ya kar\u015f\u0131 da al\u0131c\u0131 rol\u00fcn\u00fc \u00fcstlenerek takas\u0131n tamamlanmas\u0131n\u0131 taahh\u00fct ettikleri merkez\u00ee kar\u015f\u0131 taraf uygulamas\u0131n\u0131, piyasalar veya sermaye piyasas\u0131 ara\u00e7lar\u0131 itibar\u0131yla zorunlu tutabilir. Borsalar veya te\u015fkilatlanm\u0131\u015f di\u011fer pazar yerleri de nezdinde i\u015flem g\u00f6ren sermaye piyasas\u0131 ara\u00e7lar\u0131yla ilgili merkez\u00ee kar\u015f\u0131 taraf uygulamas\u0131na ge\u00e7mek \u00fczere Kurula ba\u015fvurabilirler. Merkez\u00ee takas kurulu\u015flar\u0131 organize para piyasalar\u0131nda merkez\u00ee kar\u015f\u0131 taraf uygulamas\u0131na ge\u00e7mek \u00fczere Kurula ba\u015fvurabilirler.<\/p>\n<p>(2) Takas kurulu\u015flar\u0131n\u0131n merkez\u00ee kar\u015f\u0131 taraf g\u00f6revini \u00fcstlendi\u011fi takas i\u015flemlerinde mali sorumlulu\u011fu, tesis edilecek limitler d\u00e2hilinde ve \u00fcyelerden al\u0131nacak teminatlar ile di\u011fer garantiler \u00e7er\u00e7evesinde belirlenir. Merkez\u00ee kar\u015f\u0131 taraf hizmeti \u00e7er\u00e7evesinde takas kurulu\u015flar\u0131 taraf\u0131ndan al\u0131nan teminatlar\u0131n m\u00fclkiyeti takas kurulu\u015funa ge\u00e7er. M\u00fclkiyeti takas kurulu\u015funa ge\u00e7en teminatlara aksi kanunda \u00f6ng\u00f6r\u00fclmedik\u00e7e 47 nci maddenin ikinci ve be\u015finci f\u0131kralar\u0131 ile d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendi uygulan\u0131r. Takas kurulu\u015flar\u0131, \u00fcyelerinin m\u00fc\u015fterilerine olan y\u00fck\u00fcml\u00fcl\u00fcklerinden sorumlu de\u011fildir. Takas kurulu\u015flar\u0131, merkez\u00ee kar\u015f\u0131 taraf hizmeti verdikleri piyasalarda temerr\u00fct y\u00f6netimi kapsam\u0131nda, \u00fcyelerin teminatlar\u0131, garanti fonu ve kendi sermayelerinin yan\u0131 s\u0131ra, sigorta s\u00f6zle\u015fmeleri, k\u00e2rlardan kesinti yap\u0131lmas\u0131, m\u00fc\u015fterilerin pozisyonlar\u0131n\u0131n ve teminatlar\u0131n\u0131n gerekti\u011finde resen veya temerr\u00fct eden \u00fcyenin m\u00fc\u015fterilerinin talebiyle temerr\u00fct eden \u00fcyelerin r\u0131zas\u0131 da \u015fart olmaks\u0131z\u0131n di\u011fer \u00fcyelere ta\u015f\u0131nmas\u0131, pozisyonlar\u0131n resen kapat\u0131lmas\u0131, ayn\u0131 tarafla olan bor\u00e7, alacak, pozisyon, teminat, hak ve y\u00fck\u00fcml\u00fcl\u00fcklerin netle\u015ftirilmesi ve Kurulca uygun g\u00f6r\u00fclecek di\u011fer y\u00f6ntemleri de kullanabilirler.<\/p>\n<p>(3) Merkez\u00ee takas kurulu\u015flar\u0131, temerr\u00fct y\u00f6netiminde kullanmak \u00fczere sermaye ve sermaye benzeri kaynak temin edebilir, teminat ve garanti fonu varl\u0131klar\u0131n\u0131 temerr\u00fct y\u00f6netimi \u00e7er\u00e7evesinde likidite temin etmek i\u00e7in bor\u00e7lanma amac\u0131yla teminat g\u00f6sterebilir. Merkez\u00ee takas kurulu\u015flar\u0131 nakd\u00ee teminatlar\u0131 nemaland\u0131rma veya menkul k\u0131ymetlerin saklanmas\u0131 amac\u0131yla bankalar ve saklama kurulu\u015flar\u0131nda kendi adlar\u0131na a\u00e7\u0131lacak hesaplarda bulundurabilirler. Merkez\u00ee takas kurulu\u015flar\u0131 taraf\u0131ndan temerr\u00fct y\u00f6netimine tahsis edilen sermaye ve sermaye benzeri kaynaklar hakk\u0131nda da 73 \u00fcnc\u00fc maddenin ikinci f\u0131kras\u0131 h\u00fckm\u00fc uygulan\u0131r. 73 \u00fcnc\u00fc maddenin ikinci f\u0131kras\u0131 ile 79 uncu maddenin birinci f\u0131kras\u0131, takas mutabakat\u0131n\u0131n nihai olarak sonu\u00e7lanmas\u0131na kadar ge\u00e7ecek s\u00fcre ile s\u0131n\u0131rl\u0131 olmak \u00fczere, merkez\u00ee takas kurulu\u015fu veya merkez\u00ee saklama kurulu\u015fu nezdindeki takas ve mutabakat hesaplar\u0131na yat\u0131r\u0131lan veya transfer edilen anapara de\u011fi\u015fimli para ve\/veya k\u0131ymet takas\u0131 i\u015flemlerine konu varl\u0131klar hakk\u0131nda da uygulan\u0131r.\u201d<\/p>\n<p>\u201c(9) Bu madde kapsam\u0131nda y\u00fcr\u00fct\u00fclecek temerr\u00fct y\u00f6netimine ili\u015fkin usul ve esaslar ile takas kurulu\u015flar\u0131n\u0131n merkez\u00ee kar\u015f\u0131 taraf hizmeti nedeniyle \u00fcyelerinden alaca\u011f\u0131 teminatlar ve b\u00fcnyelerinde yer alacak garanti fonlar\u0131na ili\u015fkin usul ve esaslar takas kurulu\u015funun \u00f6nerisi \u00fczerine Kurul taraf\u0131ndan belirlenir.<\/p>\n<p>(10) Merkez\u00ee takas kurulu\u015flar\u0131 taraf\u0131ndan merkez\u00ee kar\u015f\u0131 taraf hizmeti sunduklar\u0131 her bir piyasa i\u00e7in tahsis edilen sermaye veya sermaye benzeri kaynaklar, al\u0131nan teminatlar ve olu\u015fturulan garanti fonlar\u0131 ama\u00e7lar\u0131 d\u0131\u015f\u0131nda kullan\u0131lamaz. Sermaye piyasalar\u0131na ili\u015fkin olarak sunulan merkez\u00ee kar\u015f\u0131 taraf hizmeti kapsam\u0131nda al\u0131nan teminatlar ve garanti fonu varl\u0131klar\u0131, para piyasalar\u0131na ili\u015fkin olarak ayn\u0131 kapsamda al\u0131nan teminatlar ve garanti fonu varl\u0131klar\u0131ndan ayr\u0131 olarak izlenir.\u201d<\/p>\n<p><strong>MADDE 28-<\/strong> 6362 say\u0131l\u0131 Kanuna a\u015fa\u011f\u0131daki ge\u00e7ici madde eklenmi\u015ftir.<\/p>\n<p>\u201cM\u00fclkiyeti YTM\u2019ye intikal eden sermaye piyasas\u0131 ara\u00e7lar\u0131n\u0131n hak sahiplerine yap\u0131lacak \u00f6demelere ili\u015fkin usul ve esaslar<\/p>\n<p>GE\u00c7\u0130C\u0130 MADDE 10- (1) Kayden izlenmeye ba\u015fland\u0131\u011f\u0131 tarihi izleyen yedinci y\u0131l\u0131n sonuna kadar teslim edilmedi\u011fi i\u00e7in m\u00fclkiyeti YTM\u2019ye intikal etmi\u015f olan sermaye piyasas\u0131 ara\u00e7lar\u0131n\u0131n iadesi ile sat\u0131\u015flar\u0131n\u0131n yap\u0131lm\u0131\u015f olmas\u0131 h\u00e2linde bunlar\u0131n bedellerinin \u00f6denmesi talebiyle yap\u0131lacak ba\u015fvurular\u0131n ve ba\u015fvuru \u00fczerine hak sahiplerine YTM taraf\u0131ndan yap\u0131lacak \u00f6demelerin usul ve esaslar\u0131, hak sahiplerince teslim edilecek sermaye piyasas\u0131 ara\u00e7lar\u0131n\u0131n iptal ve imha esaslar\u0131 ile ihra\u00e7\u00e7\u0131lar\u0131n bu ba\u015fvurulara ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fckleri Kurulca belirlenir. \u015eu kadar ki, YTM\u2019ye intikal eden sermaye piyasas\u0131 ara\u00e7lar\u0131ndan; ilgili mevzuat uyar\u0131nca sat\u0131\u015f\u0131 yap\u0131lmam\u0131\u015f olanlar aynen; sat\u0131\u015f\u0131 yap\u0131lm\u0131\u015f olanlar ise, Kurulca belirlenen esaslar \u00e7er\u00e7evesinde hesaplanacak sat\u0131\u015f tutarlar\u0131 \u00fczerinden nakden \u00f6denir. Yap\u0131lacak \u00f6demelerde, ilgili tutar\u0131n 4749 say\u0131l\u0131 Kanunun 12 nci maddesi \u00e7er\u00e7evesinde de\u011ferlendirilmesi sonucu YTM taraf\u0131ndan fiilen elde edilen getirinin \u00f6denecek tutara isabet eden nemalar\u0131 esas al\u0131n\u0131r. Bu madde uyar\u0131nca yap\u0131lacak \u00f6demelere ili\u015fkin i\u015flemler ve bu i\u015flemlerle ilgili olu\u015fturulacak kay\u0131tlar ve d\u00fczenlenecek k\u00e2\u011f\u0131tlar damga vergisinden m\u00fcstesnad\u0131r.\u201d<\/p>\n<p><strong>MADDE 29-<\/strong> 7\/2\/2013 tarihli ve 6415 say\u0131l\u0131 Ter\u00f6rizmin Finansman\u0131n\u0131n \u00d6nlenmesi Hakk\u0131nda Kanunun 4 \u00fcnc\u00fc maddesine a\u015fa\u011f\u0131daki f\u0131kra eklenmi\u015ftir.<\/p>\n<p>\u201c(7) Bu su\u00e7 bak\u0131m\u0131ndan 5271 say\u0131l\u0131 Ceza Muhakemesi Kanununun;<\/p>\n<ol>\n<li>a) 133 \u00fcnc\u00fc maddesinde yer alan \u015firket y\u00f6netimi i\u00e7in kayy\u0131m tayini,<\/li>\n<li>b) 135 inci maddesinde yer alan ileti\u015fimin tespiti, dinlenmesi ve kayda
